Updates to OSHA’s Recordkeeping Rule: Reporting Fatalities and Severe Injuries

Who is required to report fatalities and severe injuries:
All employers under OSHA jurisdiction must report these incidents to OSHA, even employers who are exempt from routinely keeping OSHA records due to company size or industry.

What am I required to report under the new rule?
Employers now must call OSHA’s local office at 603-225-1629 or 24-hour hotline 800-321-6742 to report the following work-related incidents:

  • Fatalities (within 8 hours)
  • Inpatient hospitalizations of one or more employees (within 24 hours)
  • Amputations (within 24 hours)
  • Losses of an eye (within 24 hours)

NHADA Workers’ Compensation Trust members will have the peace of mind that work-related injury or illness data will be tracked, reported and filed accordingly with OSHA regulations. NHADA WCT will provide our members with the reports to keep on file (Form 300) and to post (Form 300A). NHADA WCT will also file the injury and illness data electronically to OSHA for our WCT members that meet the below criteria.

Form 300 Log of Work-Related Injuries and Illnesses

Information about every work-related death and about every work-related injury or illness that involves loss of consciousness, restricted work activity or job transfer, days away from work, or medical treatment beyond first aid. • Significant work-related injuries and illnesses that are diagnosed by a physician or licensed health care professional. • Work-related injuries and illnesses that meet any of the specific recording criteria listed in 29 CFR Part 1904.8 through 1904.12. https://www.osha.gov/laws-regs/regulations/standardnumber/1904

Form 300A Summary of Work-Related Injuries and Illnesses

When you receive Form 300A in January, it needs to be signed by the owner and posted for all employees to view from February 1st through April 30th.

Employers that are required to submit injury and illness data electronically to OSHA by March 2nd:

NHADA WCT will file electronically with OSHA for members that are required to do so. We will contact those members that we think should be filing electronically annually in January for the required information.

Employers with 250 or more employees and employers with 20-249 employees classified in certain high-risk industries; NAICS code 8113 Commercial Truck and Equipment, 4413 Automotive Parts, Accessories and Tire Stores, and 4442 Lawn and Garden Equipment and Supplies Stores.

Most employers don’t need to submit injury and illness data to OSHA electronically but these forms need to be completed and kept on file for at least 5 years following the year that the data covers.
