This document outlines five core principles for data sharing between dealers, OEMs, and third parties. It emphasizes compliance, security, accountability, transparency, and collaborative practices. The principles were originally released in 2022 and have been updated to reflect changes in technology and recent developments in data sharing agreements.
Data Sharing Agreement Guidelines
These guidelines contain practical information for dealers to identify areas of risk in data sharing agreements. They address critical questions such as what data is being shared, who has access, permissible uses, security measures, responsibilities in case of breaches, and termination rights.
Adhering to these principles and utilizing the checklist helps ensure that data sharing within the automotive ecosystem is conducted responsibly, securely, and in compliance with applicable laws. NADA will distribute these documents to OEMs, vendors, and dealer counsel, while also providing educational resources for dealers.
